The Punjab and Haryana High Court granted interim relief to residents of an abandoned housing project by directing that temporary electricity connections be provided to families living in the residential complex while authorities work toward a permanent solution. The Court intervened after being informed that hundreds of families residing in the project had been left without regular electricity because the builder had abandoned the development and failed to fulfill obligations relating to infrastructure and statutory dues.
The matter came before the Court through a petition filed by residents who had purchased flats in the housing project and had been residing there despite the project remaining incomplete. According to the residents, the developer had effectively abandoned the project after collecting substantial amounts from homebuyers. The directors associated with the project were stated to be absconding, leaving the occupants without access to essential civic amenities. Among the most pressing concerns raised before the Court was the absence of regular electricity connections, which had resulted in severe hardship for residents.
The residents contended that despite investing their life savings in the housing project and taking possession of their homes, they were unable to obtain proper electricity connections because of disputes involving the developer and the power utility. Throughout the proceedings, the Court emphasized that the residents were not responsible for the circumstances that had resulted in the electricity crisis. It noted that the homebuyers had purchased their flats with the expectation of receiving basic amenities and could not reasonably be expected to rectify the failures of the developer. The Court therefore sought to strike a balance between the interests of the utility provider, the obligations arising from unpaid dues and the immediate needs of the residents.
