Retired Bombay High Court judge Justice Gautam S. Patel and members of his family have allegedly been subjected to threats and acts of violence for several months in connection with his judgment in the long-standing Dawoodi Bohra succession dispute. The incidents have reportedly occurred both in India and the United Kingdom and are linked to demands that the retired judge publicly withdraw or disown the judgment he delivered while serving on the High Court.

According to the information placed in the public domain, the most recent incident involved an anonymous letter received by Justice Patel’s daughter, who resides in the United Kingdom. The letter allegedly contained grave threats directed at the family and demanded that Justice Patel publicly retract his judgment through a video statement. The communication reportedly warned of severe consequences if the demand was not complied with and referred to the existence of individuals who had allegedly been engaged to carry out the threats.

The reported campaign of intimidation is said to have begun several months earlier when similar letters were sent to members of Justice Patel’s family in India and the United Kingdom. These communications allegedly demanded that the retired judge record a public video claiming that he had been compelled or pressured into delivering the judgment. The letters reportedly insisted that he renounce the findings contained in the decision and publicly discredit the verdict.

The matter assumed greater seriousness after an alleged physical attack on Justice Patel’s daughter in the United Kingdom. It was reported that she was assaulted by a masked individual while outdoors, resulting in injuries including a broken nose. The incident is being investigated by authorities in the United Kingdom. The alleged assault, together with the threatening communications received by the family, has formed part of a broader inquiry into the incidents.

Justice Patel reportedly informed several constitutional and judicial authorities about the threats and developments. Communications were made to senior judicial functionaries as well as diplomatic authorities in relation to the incidents affecting his family. The retired judge emphasized that a judicial verdict delivered by a constitutional court cannot be withdrawn, altered, or recanted through a video statement and pointed out that legal remedies against judgments are available through established appellate procedures.

The threats are connected to Justice Patel’s judgment in the Dawoodi Bohra succession dispute, a case that involved competing claims to the position of spiritual leader of the Dawoodi Bohra community. The dispute arose following the death of the previous leader and resulted in prolonged litigation concerning succession to the office of the Dai al-Mutlaq, the spiritual head of the community.

In his judgment, Justice Patel dismissed the claim advanced by one faction and upheld the claim of Mufaddal Saifuddin as the rightful 53rd Dai al-Mutlaq. The decision brought an end to years of litigation before the Bombay High Court and represented a significant judicial determination concerning leadership within the community. However, the judgment was subsequently challenged through an appeal, and the matter continues to remain subject to judicial proceedings before a larger bench.

The communications allegedly received by the family demanded that Justice Patel publicly declare that he had been coerced into delivering the judgment. Detailed instructions were reportedly provided regarding the manner in which such a statement should be recorded and disseminated. The objective of the alleged demands was said to be the public discrediting of the judgment and the creation of an impression that the verdict had not been delivered independently.

The retired judge reportedly rejected these demands and reiterated that the appropriate method of challenging a judicial decision is through legal proceedings before appellate courts. He maintained that the appeal process already available to the parties constitutes the lawful and legitimate avenue for questioning the correctness of a judgment. According to him, attempts to compel a retired judge to publicly renounce a judgment fall entirely outside the framework of the legal system.

The incidents have also prompted concerns regarding judicial independence and the safety of judges after retirement. Justice Patel reportedly observed that judges are expected to discharge their duties without fear or favour and that the administration of justice depends upon their ability to decide cases independently. He expressed concern about the implications of threats directed not only at judges but also at their family members as a consequence of judicial decisions.

Representatives associated with the faction that had challenged the succession verdict reportedly condemned the threats and violence. They stated that such actions were unacceptable and asserted that they were committed to pursuing their challenge through lawful judicial processes. It was also suggested that the alleged acts of intimidation could have the effect of creating prejudice and distracting attention from the pending appeal proceedings.

Authorities in the United Kingdom have reportedly initiated investigations into both the threatening communications and the alleged assault. Law enforcement agencies are examining the circumstances surrounding the incidents, while inquiries continue regarding the origin of the letters and the identity of those responsible. The matter has also attracted attention because of its cross-border nature, involving events and communications occurring in more than one country.

The allegations involve attempts to pressure a retired judge into repudiating a judicial determination through extra-legal means rather than through established appellate procedures.
