Non-Compliance with Section 52A NDPS Act Vitiates Search & Seizure: Rajasthan High Court Grants Bail

The Rajasthan High Court granted bail to a man found with 510 grams of heroin, emphasizing that non-compliance with Section 52A of the Narcotic Drugs and Psychotropic Substances (NDPS) Act undermines the validity of search and seizure proceedings. Justice Rajendra Prakash Soni noted that the failure to follow mandatory procedures for inventory and disposal of seized substances significantly weakened the prosecution's case. 

The court referenced Supreme Court rulings that highlight the importance of adhering to Section 52A, underscoring that deviations invalidate the evidence collected. Consequently, the court granted bail, acknowledging that detaining the accused indefinitely served no purpose.
