ANI Sues PTI in Delhi High Court for ₹2 Crores Over Copyright Infringement

Introduction: Asian News International (ANI) has filed a lawsuit against the Press Trust of India (PTI) in the Delhi High Court, alleging copyright infringement and seeking damages of over ₹2 crores. This lawsuit stems from PTI allegedly using ANI’s video content without permission.

Incident Background: The dispute arose from an incident on June 19, 2024, involving a Delhi-Darbhanga SpiceJet flight. The air conditioning system on the aircraft malfunctioned while on the runway during a severe heatwave, causing significant distress to the passengers. ANI captured videos of the incident and disseminated them via its news feed and on social media platform X (formerly known as Twitter).

The Allegation ANI claims that PTI copied both the longer and shorter versions of these videos and published them as their own. ANI asserts that PTI’s actions constitute a clear case of copyright infringement. ANI seeks not only monetary damages but also a permanent injunction to prevent PTI from publishing any further content originally created by ANI.

Court Proceedings: Justice Mini Pushkarna presided over the initial hearing and issued summons to PTI, directing them to file a response. The case is scheduled for further hearing on August 9. During the proceedings, Senior Advocate Rajshekhar Rao represented PTI, while Senior Advocate Chander M Lall, along with advocate Sidhant Kumar, appeared for ANI.

Arguments Presented: Lall emphasized the necessity for PTI to issue an apology and a clarification to all news publications that had published the video under the PTI feed, claiming PTI had been repeatedly appropriating ANI’s content. Rao, representing PTI, countered these claims, suggesting that the situation was akin to "the pot calling the kettle black" and stating that the video was labeled as third-party content by PTI.

Mediation Suggestion: The bench initially leaned towards referring the matter to mediation to resolve the issue amicably. However, Lall opposed this suggestion, indicating that ANI preferred a judicial resolution. Consequently, the court issued formal summons to PTI, requiring them to address the allegations.

Legal Representation: ANI was represented by the law firm Unum Law, highlighting the significance of the case within the media and legal communities. The high-profile nature of the legal teams underscores the broader implications for media agencies regarding content rights and the enforcement of copyright laws.

Implications of the Case: This lawsuit highlights critical issues related to intellectual property rights within the media industry. If ANI’s claims are upheld, it could set a significant precedent, reinforcing the necessity for media organizations to respect copyright laws and the intellectual property of their competitors. The outcome could also influence the operational protocols of news agencies in handling third-party content and the acknowledgment of original sources.

Conclusion: The ANI versus PTI case serves as a crucial reminder of the importance of intellectual property rights in the digital age. As the case progresses, it will be closely watched by media professionals and legal experts alike, given its potential to shape future practices and policies in the media industry. The forthcoming hearings and the court’s eventual decision will be pivotal in determining the extent of legal protection available to content creators in the face of digital content proliferation.
