The Kerala High Court recently dismissed a petition that sought action against Saji Cherian, a former minister in the state government, for allegedly insulting the Indian Constitution. The petition was filed in response to a controversial remark made by Cherian during a speech in 2022, where he criticized the Constitution for being "faulty" and not reflective of the common man's needs.
Cherian, during his speech, had claimed that the Constitution was created by people with "elitist" views and did not serve the poor or marginalized sections of society. These comments triggered significant public outrage, with many accusing him of insulting the Constitution, which is the foundational document of the Indian Republic. Cherian later expressed regret for his words, stating that his statement was misinterpreted and that he had no intention to disrespect the Constitution.
The court, in its ruling, concluded that while Cherian’s statement was controversial, it did not amount to a criminal offense or an act of deliberate insult against the Constitution. The petition was therefore dismissed, with the court stating that such issues were not grounds for legal intervention unless they crossed the threshold of incitement to violence or hatred.
