Meghalaya High Court: PIL for NHAI to Repair Damaged NH-6 Highway

Introduction

The Meghalaya High Court recently heard a Public Interest Litigation (PIL) concerning the poor condition of National Highway 6 (NH-6) in the state of Meghalaya. The petition sought the intervention of the National Highways Authority of India (NHAI) to repair and maintain the highway, which had suffered extensive damage, leading to serious inconvenience and safety concerns for commuters. The case highlighted the significant role of judicial review in ensuring that the government and its agencies adhere to their responsibilities, particularly in maintaining critical infrastructure that directly affects public welfare.

Background of the Case

The PIL was filed by a public-spirited individual, highlighting the deteriorating condition of NH-6, a major highway that connects several important areas in Meghalaya with other parts of the country. The highway, which plays a crucial role in transportation and connectivity, had fallen into disrepair, with large potholes, uneven surfaces, and other structural issues. These conditions had led to frequent accidents, traffic disruptions, and hardships for local commuters and travelers.

The petitioner argued that the NHAI, which is responsible for the maintenance and repair of national highways, had failed in its duty to ensure that NH-6 was kept in a safe and navigable condition. The PIL sought a direction from the Court to the NHAI to immediately repair the damaged portions of NH-6 and to ensure that proper maintenance was carried out in the future to prevent such deterioration.

Legal Issue and Court's Review

The core legal issue before the Meghalaya High Court was whether the NHAI had fulfilled its statutory duties under the relevant laws governing the maintenance of national highways. The petitioner’s concern was based on the growing risks posed by the highway’s poor condition, which not only endangered lives but also disrupted the daily life of local residents and affected the economy of the region due to transportation delays.

In response, the Court noted that the NHAI has a statutory obligation to ensure the maintenance of national highways. The Court also observed that highways, being vital infrastructure, fall within the broader framework of public welfare and safety. The Court took cognizance of the serious nature of the allegations and decided to issue a notice to the NHAI, seeking their response on the issue.

Court's Direction

While the Court did not pass an immediate order, it directed the NHAI to file an affidavit regarding the condition of NH-6 and outline the steps being taken to address the issue. The Court expressed concern over the state of the highway and indicated that it would take further action if the response from NHAI was not satisfactory. It emphasized the need for prompt action to prevent further deterioration and ensure the safety of travelers.

Conclusion

The Meghalaya High Court’s decision to hear the PIL regarding the poor condition of NH-6 underscores the judiciary's important role in overseeing public infrastructure maintenance. By directing the NHAI to respond, the Court reminded the agency of its duty to ensure that national highways remain safe and functional for public use. This case also serves as a reminder to government bodies and agencies that they must be held accountable for ensuring that vital infrastructure is maintained for the welfare of the public.
