Calcutta High Court Allows Rally Protesting Against Alleged Commercial Use of Zoo Land by State Government

In a recent ruling, the Calcutta High Court permitted a rally to protest the alleged commercial use of land that forms part of the state-run Alipore Zoological Gardens in Kolkata. The rally, organized by various civic organizations and local groups, raised concerns regarding the state government’s actions in diverting a portion of the zoo land for commercial purposes. The petitioners argued that the move was not only an infringement on the ecological and social functions of the zoo but also a violation of environmental protection principles.

The rally’s primary contention revolved around the alleged encroachment on land that is traditionally dedicated to public recreation and conservation of wildlife. The petitioners emphasized that the zoo, which has been an iconic part of Kolkata’s cultural and environmental heritage, should not be subjected to commercial development that could degrade its role in public welfare. Furthermore, they argued that such commercial usage would set a dangerous precedent, undermining the fundamental purpose of the zoo as a public facility dedicated to education, conservation, and environmental awareness.

In their petition, the protestors pointed out that the state government had initiated a plan to allocate a part of the zoo’s land for building hotels and other commercial establishments, which they claimed would compromise the overall integrity of the zoo. They contended that these commercial ventures would not only disrupt the natural habitat of the zoo's animals but also diminish its status as a public resource. The petitioners sought the Court’s intervention to prevent the state government from pursuing this course of action.

In response to the petition, the Calcutta High Court observed the potential environmental implications of such a commercial project. The Court also recognized the importance of preserving public spaces like zoos for future generations and for the wider ecological benefits they provide. As a result, the Court allowed the rally to take place, stating that it was within the rights of the protestors to express their concerns. Additionally, the Court directed that the state government should consider the public sentiment and the legal aspects surrounding the land use before proceeding with any further actions.

This ruling highlights the growing tension between urban development and environmental conservation. It underscores the need for governments to balance developmental goals with the preservation of natural spaces that serve public interests. The Court’s decision reinforces the legal framework that protects public spaces from being exploited for commercial purposes without adequate scrutiny and consideration of the public's concerns.
