Kerala High Court Directs Registry to Provide P.P. Divya with Documents in ADM Naveen Babu Suicide Case

The Kerala High Court recently directed its Registry to provide P.P. Divya with copies of the writ petition and associated documents filed by Manjusha, the widow of deceased Additional District Magistrate (ADM) Naveen Babu. Divya, a member of the Communist Party of India (Marxist), is accused of abetting Babu's suicide by allegedly humiliating him during his farewell function. Manjusha had filed a writ petition seeking a Central Bureau of Investigation (CBI) probe into her husband's death, asserting that due to Divya's political influence, an impartial investigation by the CBI was necessary.

ADM Naveen Babu was found hanging in his official quarters on October 15, 2024. Manjusha alleged a homicidal angle to the incident and contended that Divya's political connections could compromise the integrity of the investigation conducted by the Special Investigation Team (SIT). However, the High Court dismissed Manjusha's writ petition, stating that Divya's ties with the ruling political party were not sufficient grounds to transfer the investigation to the CBI.

Following the dismissal, Manjusha filed a writ appeal, arguing that the refusal to order a CBI probe overlooked flaws and discrepancies in the SIT's investigation. The High Court subsequently dismissed this appeal as well, concluding that there was no legitimate apprehension of partiality or impropriety in the current investigation.

In response to these developments, Divya sought access to the documents filed by Manjusha in her writ petition. Since Divya was not a party to the original writ petition, she filed an application requesting certified copies of the memorandum of the writ petition, exhibits, counter-affidavits, reply affidavits, and other related documents. The single bench of Justice Kauser Edappagath granted this request, referencing previous decisions that established the petitioner's entitlement to such documents.

This order underscores the court's commitment to ensuring transparency and fairness in legal proceedings, allowing individuals implicated in a case to access pertinent documents, even if they are not direct parties to the original petition.
