In a significant ruling, the Jammu and Kashmir and Ladakh High Court underscored the importance of timely applications for deferring the cross-examination of prosecution witnesses to safeguard the defense strategy. The court emphasized that such applications should be made before the commencement of cross-examination, as delaying the request could undermine the very purpose of deferral.

The case at hand involved a petition filed by Ravinder Kumar and others, challenging the decision of the Principal Sessions Judge, Jammu, who had rejected their plea to defer the cross-examination of six key eyewitnesses in a murder trial. The prosecution had presented these witnesses, all closely related to the deceased, to establish the charges against the accused. The petitioners contended that cross-examining these witnesses before the examination-in-chief of all prosecution witnesses would expose their defense strategy, potentially allowing the prosecution to tailor its case accordingly.

Justice Rajesh Sekhri, while allowing the petition, highlighted the legislative intent behind Section 254(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which permits the deferment of cross-examination. The court noted that the application for deferring cross-examination should be filed as early as possible, but in any case, before the commencement of cross-examination.
