In a significant judgment, the Madhya Pradesh High Court upheld the denial of bail to an advocate accused under the Unlawful Activities (Prevention) Act (UAPA) for allegedly attempting to disrupt communal harmony and establish a 'Mughal Order' in India. The Division Bench, comprising Justice Vivek Agarwal and Justice Devnarayan Mishra, dismissed the lawyer's appeal, emphasizing the seriousness of the allegations and the prima facie evidence against him.

The case originated when the National Investigation Agency (NIA) arrested the advocate, who was reportedly involved in conducting legal awareness programs. Seized materials from his residence included books, CDs, a computer, pen drives, bank account details, pamphlets, lectures, and written documents. These items allegedly contained content promoting communal discord and advocating for the establishment of a 'Mughal Order' that existed before British colonial rule.

The advocate challenged the trial court's decision to deny him bail, arguing that his activities were limited to legal awareness and did not constitute unlawful activities under the UAPA. However, the High Court found the evidence compelling, noting that the materials seized indicated a deliberate attempt to disrupt communal harmony and promote ideologies contrary to India's constitutional values. The court observed that such actions, if proven, could have far-reaching implications on national security and public order.

The High Court's decision underscores the judiciary's commitment to upholding national security and public order while balancing individual rights.
