The Madhya Pradesh High Court continued interim relief granted to Trinamool Congress MP Abhishek Banerjee in a defamation case by keeping the execution of an arrest warrant issued against him in abeyance. The matter arose from a criminal defamation complaint filed against Banerjee, alleging that certain remarks made by him during a public meeting were defamatory. The High Court examined the circumstances surrounding the issuance of the warrant and allowed the interim protection to continue while the proceedings remained pending.
The defamation case was initiated following allegations that Abhishek Banerjee made statements against the complainant during a public address. The complainant alleged that the remarks affected his reputation and constituted an offence of criminal defamation. Based on these allegations, proceedings were initiated before the concerned court in Madhya Pradesh.
During the course of the proceedings, an arrest warrant came to be issued against Banerjee after his non-appearance before the lower court. The Court did not examine the truthfulness of the allegations or decide the merits of the defamation complaint at this stage. The order was limited to determining whether the coercive steps initiated against Banerjee should continue while the challenge remained pending.
The Court observed the need to examine the procedural aspects of the case before allowing further action based on the warrant. The interim order ensured that no immediate steps were taken pursuant to the arrest warrant while the High Court considered the matter in detail.
The High Court also issued directions for further proceedings in the petition and kept the matter open for consideration. The parties were required to place their respective submissions before the Court regarding the challenge to the warrant and the proceedings arising from the defamation complaint.
The case involved the question of whether the arrest warrant issued during the pendency of criminal defamation proceedings required interference by the High Court. The Court considered the circumstances of the proceedings and found it appropriate to continue the interim protection granted to Banerjee.
The High Court’s order did not terminate the criminal proceedings or decide the allegations made in the complaint. The defamation case continued to remain pending before the appropriate forum. The only relief granted was protection against the immediate execution of the arrest warrant while the High Court examined the issues raised before it.

The Madhya Pradesh High Court ultimately continued the interim protection granted to Abhishek Banerjee and kept the arrest warrant proceedings in abeyance.
