Calcutta High Court Settles Dispute Between Dhruv Rathee and Dabur Over Real Fruit Juice

Background of the Dispute

The dispute between Dabur India and popular YouTuber Dhruv Rathee revolved around a video uploaded by Rathee on his YouTube channel. In the video, Rathee critiqued the health impacts of packaged fruit juices, specifically highlighting Dabur's "Real" fruit juice, by comparing it with fresh fruit juices. The content of the video used the logo and trademark of Real fruit juice, leading Dabur to file a lawsuit against Rathee for the unauthorized use of their brand and potential damage to its reputation.

Legal Proceedings and Initial Court Order

The legal battle, which lasted nearly a year, saw Dabur India objecting to Rathee's use of their trademark in his video. In an earlier order passed in March 2023 by Justice Ravi Krishan Kapur, YouTube and other social media platforms were instructed to take down or block access to the contentious video. The Court had determined that Rathee's video had crossed the "Lakshman Rekha" by making potentially harmful comparisons and implications regarding the health effects of Real fruit juice, especially on children.

Settlement Agreement

The resolution came when both parties agreed to a settlement proposed by Rathee. He offered to blur the packaging of Dabur's Real fruit juice in his video, thereby addressing the concerns raised by Dabur regarding the use of their trademark. This proposal was initially made via email on March 15, 2024, and was accepted by Dabur on March 19, 2024. Following this agreement, Rathee forwarded a revised version of the video on June 12, 2024, which contained generic fruit juice packaging instead of Dabur’s specific branding.

Court's Final Order

Justice Krishna Rao recorded the settlement in an order passed on June 18, 2024. The Court acknowledged that both parties had reached an amicable solution where Rathee’s revised video removed all references to Real trademarks, copyright content, labels, and advertisements. The Court noted that since the changes were made to Dabur's satisfaction, the company had no further objections to the video being available on social media platforms. Consequently, the Court concluded that no useful purpose would be served by continuing with the lawsuit and disposed of the case in terms of the settlement agreed upon by both parties.

Legal Representation

In the proceedings, Dabur India was represented by Advocates Debnath Ghosh, Biswaroop Mukherjee, Abir Debnath, and Pradipta Bose. Dhruv Rathee’s legal team included Senior Advocate Ranjan Bachawat and advocates Satyaki Mukherjee, Nakul Gandhi, Yash Vardhan Deora, Eshna Kumar, and Mujeeb Rahman. YouTube, also a party in the litigation, was represented by advocates Neel Mason, Phiroze Edulji, Ankit Rastogi, Roustavi Mukherjee, and Priyanka Bhattacharya.

Implications of the Settlement

The settlement is significant for several reasons. Firstly, it underscores the importance of respecting trademarks and copyrights in digital content, even when making fair comments or critiques. Secondly, it highlights the potential for amicable resolutions through negotiation, even in disputes that initially seem contentious. Finally, it sets a precedent for how similar cases might be handled in the future, balancing the rights to free speech and expression with the protection of corporate trademarks and reputations.

Conclusion

The resolution of the dispute between Dhruv Rathee and Dabur India over the Real fruit juice video by the Calcutta High Court marks the end of a significant legal tussle. By agreeing to blur the packaging in his video, Rathee addressed Dabur's concerns, leading to a mutually acceptable settlement. This case highlights the complexities of trademark use in digital content and the importance of finding balanced solutions that respect both free speech and intellectual property rights. The Court's decision to close the suit following the settlement agreement is a positive step towards fostering understanding and cooperation between content creators and corporations.
