Allahabad High Court Awards Compensation in LLB Admission Cancellation Case

The Allahabad High Court awarded Rs. 5 lakh in compensation to Ajay Kumar Pandey, a 35-year-old law student whose admission to an LLB program was canceled due to an administrative error by the college. The court ruled that Pandey was not at fault, as the college admitted him despite his undergraduate degree being from 2008, contrary to the 2016 rule. Though he passed his first-semester exams, his admission was annulled. The court acknowledged the college's negligence and compensated Pandey for jeopardizing his academic career.

Background of the Case

Pandey had enrolled in a law college affiliated with Deen Dayal Upadhyay Gorakhpur University in 2019, under the belief that his qualifications met the college's admission criteria. However, after successfully completing his first semester, his admission was revoked by the university on the grounds that his undergraduate degree dated back to 2008, while the college brochure required a degree from 2016 onwards. The cancellation came as a surprise to Pandey, who had already invested time and effort into his legal studies.

Legal Proceedings

Pandey initially approached the court for reevaluation of his exam results. While his marks were increased, his admission remained canceled, barring him from continuing to the second year. Pandey argued that the fault lay with the college, which processed and approved his admission despite his eligibility discrepancy. He contended that it was unjust for him to suffer the consequences of the college's administrative error.

High Court’s Ruling

The Allahabad High Court, in its ruling, acknowledged that Pandey had not committed any fraud or misrepresented his qualifications. The court highlighted the college's reckless behavior in admitting students without adhering to its own admission guidelines. Although the court could not reinstate his admission, it awarded Pandey Rs. 5 lakh as compensation, citing the college’s role in jeopardizing his academic future. The amount was deemed reasonable in light of the harm caused to Pandey’s education and career trajectory.
