Bombay High Court Issues Notice on Dialysis Services Contract
Background of the Dispute

The Bombay High Court has issued a notice in response to a petition challenging an MoU between the Maharashtra government and HLL Life Care Ltd., a government-owned entity known for manufacturing sanitary napkins and condoms. The MoU relates to the establishment of dialysis centers in public hospitals under the National Rural Health Mission (NRHM).

Concerns Raised by Petitioners

The petitioners, an association of dialysis service providers, have questioned HLL Life Care’s lack of experience in the healthcare sector, especially in dialysis services. They argue that awarding the contract to HLL without a proper tender process violates Article 14 of the Indian Constitution, which guarantees equality before the law. The petitioners also claim that the closed tender process restricted participation to only those already registered with HLL, further raising concerns about fairness and transparency.

Court's Inquiry into the Tender Process 

During the hearing, the Court questioned the basis for limiting the tender to entities already registered with HLL, given that it is a government-owned entity. The petitioners highlighted that the state government did not conduct an open tender process, selecting HLL through a nomination basis instead. This has led to questions about the rationale and legality of the selection process.

Demands by the Petitioners 

The petitioners have requested the Court to declare the MoU illegal and unconstitutional. They have also sought the quashing of the tender notice issued by HLL, contending that the entire process was arbitrary and violated their rights to participate in a fair bidding process for public healthcare services.

Conclusion 

The case, titled Dialysis Service Providers Association vs Union of India & Ors., raises critical questions about fairness in public contracts, especially concerning essential healthcare services. The Bombay High Court’s notice signals that the matter requires careful examination to ensure transparency and accountability in the allocation of public health service contracts.
