In a significant ruling, the High Court of Jammu & Kashmir and Ladakh underscored the imperative for judicial sensitivity and meticulousness in adjudicating bail applications. Justice Sanjay Dhar emphasized the necessity for trial courts to eschew the prevalent "copy-paste syndrome," cautioning that such practices could jeopardize individuals' fundamental rights.

This admonition emerged during the hearing of a bail plea filed by Umar Bashir Khan, implicated under Sections 451, 376/511, 354, and 506 of the Ranbir Penal Code (RPC). Khan faced allegations of unlawful entry into the prosecutrix's residence, assault, attempted sexual assault, and issuing threats to her life.

The case's origins trace back to December 2018, when the prosecutrix lodged a complaint asserting that Khan had intruded into her home during the night of December 5–6. She alleged that he assaulted her, attempted a sexual violation, and threatened her life. Subsequently, the police registered an FIR, recorded her statement under Section 164 of the Criminal Procedure Code (CrPC), and, by 2021, filed a chargesheet substantiating offenses under the specified sections.

Throughout the investigation, Khan remained in custody due to a separate FIR under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Upon his release from that detention, he sought bail for the current charges. However, in September 2024, the trial court denied his application, basing its decision on an erroneous factual premise. The court's order inaccurately suggested that Khan had sexually exploited the prosecutrix under the guise of marriage—a claim unconnected to the actual allegations.

Khan's legal counsel contended that the trial court's rejection was mechanical, lacking a thorough examination of the case's specifics and the available evidence. They highlighted that during her court testimony, the prosecutrix deviated from her initial allegations, attributing the incident to a familial dispute.

Upon reviewing the submissions and evidence, Justice Dhar delivered a scathing critique of the trial court's approach. The High Court observed that the trial court's rationale was predicated on an entirely irrelevant narrative, bearing no relation to the actual case against Khan. Justice Dhar remarked, "From a perusal of the afore-quoted observations of the trial court and, in fact, from a perusal of the order passed by the trial court, it appears that the learned trial court has not applied its mind to the facts and circumstances of the case."

The High Court's ruling serves as a poignant reminder of the critical role of judicial diligence in safeguarding individual rights. By admonishing the trial courts to avoid perfunctory practices and to engage in a thorough, case-specific analysis, the court aims to uphold the integrity of judicial proceedings and ensure that justice is administered with the requisite care and attention.
