Allahabad High Court Denies Bail to Man Accused of Forcing Wife into Prostitution

In a significant ruling, the Allahabad High Court recently denied bail to a man accused of coercing his wife into prostitution by compelling her to engage in sexual relations with his friends and other individuals. The court emphasized that such allegations are a severe affront to the victim's dignity and self-esteem, extending beyond a mere matrimonial dispute.

Case Background

The case originated from a First Information Report (FIR) lodged on June 17, 2024, by the complainant, who is the mother of the victim. According to the FIR, the victim married the accused in February 2024. Post-marriage, the complainant became aware of the accused's involvement in illicit activities and his efforts to isolate her daughter from her family. After considerable effort, the complainant located her daughter, who revealed that her husband had been forcibly compelling her to engage in sexual activities with other men.

Legal Proceedings

Following the FIR, the accused was arrested in August 2024 and charged under multiple sections of the Indian Penal Code (IPC), including Sections 498-A (husband or relative of husband subjecting a woman to cruelty), 323 (voluntarily causing hurt), 328 (causing hurt by means of poison, etc., with intent to commit an offence), 376-D (gang rape), 504 (intentional insult with intent to provoke breach of the peace), 506 (criminal intimidation), 120-B (criminal conspiracy), as well as Sections 3/4 of the Dowry Prohibition Act.

Arguments Presented

The defense contended that the accused had been falsely implicated due to matrimonial discord and that the complainant, along with her husband, had taken the victim away from her matrimonial home with police assistance. Conversely, the prosecution argued that the accused had married the victim with the ulterior motive of forcing her into prostitution. They alleged that he harassed the victim by sending his friends and other individuals into her room for sexual relations, thereby committing a heinous offence.

Court's Observations

Justice Sanjay Kumar Singh, presiding over the case, noted that the allegations were exceptionally serious and not indicative of a simple matrimonial dispute. The court observed that such actions are a profound violation of the victim's dignity, causing not only physical harm but also deep psychological trauma. The judgment emphasized that a rapist inflicts not only physical injuries but also leaves an indelible mark on a woman's dignity, honour, and reputation.
