The Kerala High Court has dismissed the anticipatory bail petition of Mohammed Shuhaib, the founder and CEO of MS Solutions, who was accused of leaking State Board Class 10 question papers through his YouTube channel. Shuhaib contended that he had merely predicted probable questions based on previous papers, but the court found this defense unconvincing and revoked the interim relief against arrest that had been granted earlier.
The allegations against Shuhaib arose when the Crime Branch registered a case, accusing him of leaking question papers for the Class 10 English and Plus-One Mathematics half-yearly examinations. Subsequent raids on his residence and office in Koduvally led to the seizure of electronic devices, including a laptop, hard drive, and mobile phone. Shuhaib responded by seeking anticipatory bail from the Principal District and Sessions Court in Kozhikode, which was denied.
In his defense, Shuhaib alleged that the complaint against him was motivated by professional rivalry from other educational institutions and aimed to divert attention from similar allegations against the tuition center lobby and the office of the Education Minister. Despite these claims, the High Court emphasized the need to address the concerns of the student community regarding the integrity of the examination process. The court had previously directed Shuhaib to appear before the police to record his statement, underscoring the necessity of a thorough investigation to dispel any doubts among students.
During the bail hearings, the court requested the production of the allegedly leaked question papers and the corresponding YouTube videos to assess the validity of Shuhaib's claims. The court also denied a request from Shuhaib's counsel to allow him to appear personally to explain his methodology for predicting questions, indicating that such explanations should be part of the investigative process rather than the bail proceedings.
