The Kerala High Court recently dismissed a petition filed by Congress MLA Mathew Kuzhalnadan, which sought a vigilance investigation into alleged financial transactions involving Chief Minister Pinarayi Vijayan, his daughter Veena Thaikandiyil, and Cochin Minerals and Rutile Limited (CMRL). Justice K. Babu, presiding over the case, emphasized that initiating an unwarranted corruption probe against a public servant could tarnish their career and reputation. He noted that being summoned as an accused in a criminal court is a grave matter that impacts an individual's dignity, self-respect, and societal image.
Kuzhalnadan's petition alleged that CMRL had been paying Veena Thaikandiyil Rs. 5 lakh per month and her company, Exalogic Solutions, Rs. 3 lakh per month under the guise of IT and marketing consultancy services. He contended that these payments were, in reality, bribes intended to secure favorable decisions from the Chief Minister. The petition was filed after a vigilance court declined to order an investigation into these claims.
In his comprehensive 59-page judgment, Justice K. Babu observed that Kuzhalnadan failed to present concrete facts constituting the alleged offenses, relying instead on mere suspicions. The court highlighted that the materials provided by the complainant only raised suspicions and did not establish factual evidence of wrongdoing. However, the court clarified that this dismissal does not prevent Kuzhalnadan from filing a fresh complaint in the future, should he obtain adequate material evidence.
Furthermore, the High Court criticized the vigilance court's earlier remarks suggesting that Kuzhalnadan's petition might have been politically motivated. Justice K. Babu deemed such observations unwarranted, emphasizing that initiating criminal proceedings is a fundamental aspect of the criminal justice system, allowing citizens, including political leaders and legislators, to seek the prosecution of alleged offenders in the interest of society.
This ruling aligns with previous decisions in related cases. For instance, in May 2024, a vigilance court in Thiruvananthapuram dismissed a similar petition by Kuzhalnadan, which sought a court-monitored probe into the financial dealings between CMRL and Exalogic Solutions. The court concluded that the petitioner had not provided sufficient evidence to warrant an investigation.
Additionally, in July 2024, the Kerala government informed the High Court that Chief Minister Pinarayi Vijayan had not personally benefited from the transactions between CMRL and Exalogic Solutions. The government asserted that all properties associated with the Chief Minister were legally accounted for, countering allegations of personal gain.
These developments underscore the judiciary's cautious approach in handling allegations of corruption against public officials, emphasizing the necessity for concrete evidence before initiating investigations that could potentially damage reputations and careers.
