Bombay High Court Rejects PIL on Social Media Misuse by Influencers and Comedians

On April 30, 2025, the Bombay High Court dismissed a Public Interest Litigation (PIL) filed by Shiv Sena MLA Kiran Samant, which sought to address the alleged misuse of social media by influencers, content creators, and comedians. The PIL specifically cited comedian Kunal Kamra's content, claiming it tarnished the judiciary's image. Samant's counsel argued that Kamra's videos exemplified the misuse of social media platforms, and the PIL aimed to establish a Social Media Vigilance Committee to monitor and censor content that purportedly violated reasonable restrictions on free speech.

The bench, comprising Chief Justice Alok Aradhe and Justice M.S. Karnik, observed that the PIL presented general prayers that could not be entertained. The court emphasized that existing remedies under the Information Technology (Blocking) Rules were available to address such concerns. It noted that the PIL lacked specificity and did not demonstrate the necessity for the proposed Social Media Vigilance Committee. Consequently, the court disposed of the PIL, effectively rejecting the request for judicial intervention in this matter.
