In a significant judgment, the Gujarat High Court upheld the dismissal of nine railway constables for dereliction of duty related to the 2002 Godhra train burning incident. The nine railway constables were assigned to travel on the Sabarmati Express to provide security, as the train was categorized as an 'A' category train due to its high risk of untoward incidents. However, instead of boarding the assigned train, the constables chose to travel by the Shanti Express, which departed earlier. They also made false entries in the train register to indicate compliance with their duty assignments. 

Court's Observations on Duty Negligence

Justice Vaibhavi D. Nanavati, in a detailed 110-page judgment, noted that the constables' absence from the Sabarmati Express left the train without any security personnel, particularly in the S-6 compartment where the attack occurred. The court emphasized that had the constables performed their duties as assigned, the incident might have been prevented. The judgment stated:

"If the petitioners had departed in Sabarmati Express train itself to reach Ahmedabad, the incident that occurred at Godhra could have been prevented. The petitioners' derelict negligence and carelessness towards their duty stand proved." 

Disciplinary Proceedings and Legal Justifications

The disciplinary authority initiated proceedings against the constables, resulting in their dismissal from service. The appellate and revisional authorities upheld these decisions, citing the constables' misconduct and negligence. The High Court affirmed these findings, stating that the disciplinary actions were based on reasoned and justified grounds.
