Jammu & Kashmir High Court Stays Criminal Proceedings Against Relatives of Ghulam Nabi Azad

On May 15, 2025, the Jammu & Kashmir High Court issued an interim order staying criminal proceedings against two relatives of former Chief Minister Ghulam Nabi Azad. The proceedings, initiated in a complaint filed by an Aam Aadmi Party worker and director of Hyber Hightech Innovative Engineering and Infrastructure Pvt. Ltd., were pending before the Sub-Judge (JMIC) court in Jammu.

The petitioners, Mubashar Ali and Yawar Ahmed, were accused in a case involving a business transaction with the complainant's company. According to the petitioners' counsel, their firm, Chenab Enterprises, had been hired by the complainant to provide transport services under a formal work order. In return, a cheque of ₹43 lakh was issued to the petitioners, signed by both directors of the company, including the complainant. After two partial payments of ₹10 lakh each were made from the petitioners' account, the complainant filed a complaint against them. Subsequently, the J&K Bank froze the petitioners' accounts, and criminal proceedings were initiated without prior notice to them.

The petitioners contended that the freezing of their accounts and the initiation of criminal proceedings were baseless and intended to deprive them of their legitimate dues. They argued that the actions taken against them violated their fundamental rights and due process.

Justice Rajesh Sekhri, presiding over the case, found merit in the petitioners' arguments. He issued an interim order staying the criminal proceedings before the trial court and directed that notices be issued to the complainant and other respondents. The court's decision underscores the importance of adhering to legal procedures and protecting individuals from arbitrary actions that could infringe upon their rights.

This development highlights the judiciary's role in ensuring that legal processes are not misused to settle personal grievances or for ulterior motives. It also serves as a reminder of the need for transparency and accountability in business transactions and the legal actions that follow.
