Allahabad High Court Closes Chapter on Police Treating Court Order as FIR After SP’s Regret and Corrective Steps

The Allahabad High Court brought a controversial episode to a close after police in Ballia treated a judicial directive as a First Information Report by reproducing the court order verbatim instead of following mandated procedures to register an FIR. The court had earlier harshly criticized the conduct of the Superintendent of Police in Ballia, characterizing it as both contemptuous and “manifestly illegal,” and had sought an explanation from him.

In compliance with the court’s direction, the SP submitted an affidavit admitting that the initial FIR was registered solely by transcribing the High Court's order into the police’s check form, with no written complaint from any citizen. The SP candidly acknowledged that the entire FIR registration was improper and attributed it to negligence by the Station House Officer responsible at the time. He detailed steps taken to rectify the impropriety: canceling the original FIR and ordering a fresh complaint to be taken in accordance with legal protocol.

A replacement FIR was duly registered on the basis of a written complaint from the petitioner, obeying the court's instructions. The SP confirmed that the SHO who had registered the improper FIR was placed under preliminary inquiry, and all relevant officers were sensitized to prevent recurrence of such procedural breaches. The court reviewed these actions and deemed them sufficient compliance, noting the fresh FIR and cancellation of the original improper report as fully responsive to its earlier concerns.

Following these developments, the High Court declared that the issue regarding the improper FIR registration could be considered settled. It remarked that with the corrective steps executed, it would rest that part of the proceedings and await further listing as scheduled.
