Bombay High Court Clarifies Disclosure of Demographic Information Under the Aadhaar Act

The Goa Bench of the Bombay High Court recently addressed a significant legal question concerning the disclosure of demographic information under the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits, and Services) Act, 2016. The case arose from the State of Goa’s application to the Unique Identification Authority of India (UIDAI) seeking the release of demographic details of one Yaniv Benaim, also known as Atala, an Israeli national who had obtained an Aadhaar card without providing valid documentation. The State required this information to investigate the circumstances of the issuance and to ensure compliance with legal requirements, raising questions about the balance between privacy rights and investigative needs.

The Court distinguished between two categories of information protected under the Aadhaar framework: personal information and demographic information. Personal information includes sensitive details such as biometric data, which are strictly protected under the Act and cannot be disclosed without consent, except under narrowly defined circumstances. Demographic information, on the other hand, refers to details such as proof of identity (POI), proof of birth (POB), and proof of address (POA) provided during the Aadhaar enrollment process. The Court clarified that providing such demographic information does not constitute disclosure of personal information and, therefore, does not infringe upon an individual’s fundamental right to privacy.

The Court emphasized that disclosure of demographic information is directly relevant to ongoing investigations, particularly where there are concerns regarding the issuance of Aadhaar cards to foreign nationals without proper documentation. In the present case, the State of Goa required these details to verify the identity and eligibility of the individual and to ensure that the Aadhaar system was not being misused. The Court observed that withholding demographic information in such situations could hinder the investigation and potentially allow improper access to services or benefits.

While recognizing the importance of privacy, the Court noted that the Aadhaar Act itself provides a clear legal framework for disclosure of certain categories of information in specified circumstances, including for law enforcement and investigative purposes. The ruling reiterated that demographic information, unlike biometric or other sensitive personal data, can be disclosed lawfully to support legitimate governmental or investigative objectives. The Court further cited precedents in which similar disclosures had been permitted, reinforcing the principle that the integrity of the Aadhaar system and compliance with the law take precedence when it comes to non-sensitive information necessary for investigation.

In conclusion, the Bombay High Court’s judgment clarifies that disclosure of demographic information under the Aadhaar Act is legally permissible when it serves an investigative purpose and does not compromise the privacy of an individual. The Court balanced the need for individual privacy with the State’s responsibility to maintain the integrity of the Aadhaar system and prevent misuse. By distinguishing between personal and demographic information and affirming that the latter can be disclosed under the Act, the ruling provides crucial guidance for future cases involving the investigation of Aadhaar-related matters.
