Delhi High Court Quashes FIR Between Neighbours, Directs Community Service During Navratra & Diwali

The Delhi High Court has quashed an FIR filed against a husband and wife by their neighbour, following a physical altercation. Justice Anish Dayal issued the order after the accused couple agreed to organize a "bhandara" (community meal) for at least 50 underprivileged children during the Navratra and Diwali festivals. The Court mandated that they submit a report, including photographs, of the events to the investigating officer and directed compliance with the settlement terms. The FIR was quashed subject to this undertaking.

The complainant, accompanied by her husband, informed the Court that she had no objection to the FIR being quashed, as the dispute had been amicably resolved between the neighbours. Justice Dayal noted that continuing the legal proceedings would be a misuse of the judicial process and an unnecessary burden on the State exchequer, given the remote likelihood of conviction.

The case, titled Brij Ballabh Gaur and Another v. The State of NCT of Delhi and Another, underscores the Court's approach to resolving disputes through restorative justice and community service, promoting reconciliation over prolonged litigation.
