A petitioner in the Gujarat High Court has moved a plea seeking a stay on the release of the teaser for the upcoming film Jolly LLB 3, alleging that it mis-portrays the judiciary and could undermine public trust in legal institutions. The challenge targets certain dialogue from the teaser, which the petitioner claims are derogatory to lawyers and judicial officers.
The petitioner has asked the court to direct the Central Board of Film Certification (CBFC) to explain its certification process for the teaser, and to clarify whether the board considered the challenged dialogues before granting clearance. The case raises broader questions of freedom of expression, artistic license, and the threshold for what constitutes defamatory or contemptuous portrayal of the judiciary.
In response, the court has issued a notice to the makers of the film as well as to the CBFC, asking them to respond to the petition. The court has also sought the CBFC’s certified record of the approval of the teaser to ascertain what was looked into by the CBFC before granting certification.
The High Court is now weighing whether the objections raised in the petition are sufficient to justify any interim relief, such as ordering a stay on the teaser’s release. The petitioners argue that harm can result even before the film’s full release, with the teaser itself being impactful on public perceptions. The respondents are expected to justify how the CBFC satisfied its mandate under the relevant laws and whether the content falls outside what is permissible, even for certified material.
