Madhya Pradesh High Court Considers PIL Against Jolly LLB 3 Song ‘Bhai Wakeel Hai’, Accuses It of Ridiculing Legal Profession

The Madhya Pradesh High Court has admitted a public interest litigation challenging the song ‘Bhai Wakeel Hai’ from the upcoming movie Jolly LLB 3, alleging that it ridicules the legal profession and portrays lawyers in a disparaging manner. The petitioner, an advocate, claims that the depiction trivializes the dignity of the legal community by showing actors, who play lawyers, dancing while donning neck bands—symbols of solemnity, responsibility, and professional integrity in the judiciary.

The lawsuit contends that such treatment not only disrespects the legal fraternity but also violates Section 5B of the Cinematograph Act, which prohibits content that would tend to bring the judiciary into contempt. Furthermore, the petition asserts that the lyrics of the song are objectionable and obscene, potentially undermining public morals and influencing young minds negatively.

Emphasizing constitutional considerations, the petitioner cites that while the right to freedom of speech and expression is protected, it is subject to limitations in the interest of decency, morality, and maintaining the authority of judicial institutions. Thus, he has sought relief in the form of a court-mandated disposal of representations already submitted to the authorities, alongside a direction suspending the song’s exhibition across all platforms.

In support of his plea, the petitioner points to a recent order by the Allahabad High Court, which dismissed a similar petition challenging the same song. The ruling from that court held that upon review, the song’s lyrics and portrayal offered nothing objectionable or contemptuous toward the legal profession.

The bench comprising Chief Justice and Justice appointed to the Madhya Pradesh High Court acknowledged the similarity between that earlier order and the present case. With the petition clearly representing broader public interest, the court admitted the petition for further proceedings. A hearing is scheduled to occur on the specified date, allowing the petitioner’s claims and the authorities’ findings regarding the film’s certification and content to be evaluated in more depth.
