The Allahabad High Court has intervened to protect a law student undergoing disciplinary proceedings at Babasaheb Bhimrao Ambedkar University, Lucknow, arising from allegations concerning a video that purportedly contained derogatory remarks about Dr. B. R. Ambedkar. The student, a fourth-semester LLB (Honours) enrollee, had been suspended by the university on February 13, 2025, and declared the university campus out of bounds for him. Concurrently, a Proctorial Board inquiry was initiated against him.
In the petition before the High Court, the student contended that he had been falsely implicated in relation to the video alleging derogatory remarks against Ambedkar. He sought relief, inter alia, to participate in the inquiry under protection. The university, through its counsel, responded that the student had not been appearing before the Proctorial Board, citing reasons of fear or otherwise, but assured that if he did appear, the board would expeditiously take a decision.
The court, noting that no final decision had yet been taken by the Proctorial Board on the suspension or any further disciplinary action, disposed of the petition by permitting the student to appear before the board within one week. Crucially, the court ordered that full security be provided to him, ensuring no harm would befall him during his appearance. Should the need arise, the court directed the Commissioner of Police, Lucknow, to ensure that proper safety and security arrangements be made to facilitate his attendance.
Further, the court directed that the Proctorial Board, after hearing from the petitioner and following the prescribed regulations, should issue a reasoned order, preferably within two weeks thereafter. The court also preserved the student’s right to challenge any adverse decision of the Proctorial Board by returning to the High Court.
