The Allahabad High Court has granted bail to a 20-year-old man, Jaid, who was arrested for liking a video posted by a Pakistani citizen on social media and commenting "Pakistan Zindabad." The video depicted an alleged incident where the Indian Army reportedly attacked Pakistan at night. The prosecution charged Jaid under Sections 152 (provocation with intent to cause riot), 115(2) (abettor present when offence is committed), and 351(2) (assault) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
During the bail hearing, Jaid's counsel argued that the comment was made inadvertently and did not contain any religious or derogatory remarks against India. The counsel further contended that Jaid had been in custody since May 2025 and that the charge sheet had already been filed, eliminating the need for further custodial interrogation.
Justice Arun Kumar Singh Deshwal, while granting bail, noted that the comment did not undermine India's sovereignty or dignity. The court imposed a condition that Jaid must refrain from posting any objectionable content on social media during his release.
This decision underscores the judiciary's approach to balancing national security concerns with individual rights, emphasizing that not all expressions on social media that reference foreign nations constitute offenses under national security laws.
