On October 15, 2025, the Allahabad High Court granted bail to Mohd. Kamil, an alleged operative of Al-Qaeda in the Indian Subcontinent (AQIS) and Jamaat-ul-Mujahideen Bangladesh (JMB), who had been booked under various sections of the Indian Penal Code and the Unlawful Activities (Prevention) Act (UAPA). The bench comprising Justice Rajesh Singh Chauhan and Justice Abdhesh Kumar Chaudhary allowed the bail application, citing the principle of parity with other co-accused who had been granted bail earlier.
Kamil was arrested on charges of aiding in the preparation of sleeper modules for AQIS and JMB in Uttar Pradesh. The allegations against him included recruiting individuals and spreading anti-national, jihadi, and terrorist ideologies to threaten the unity, sovereignty, and integrity of the nation and destabilize the democratically elected government. Despite the serious nature of these allegations, the court noted that other co-accused individuals had been granted bail in similar circumstances.
The Supreme Court had previously directed the High Court to decide Kamil's bail plea within three months. Considering the fact that six criminal appeals of nine co-accused persons had been allowed by the High Court last year, and the allegations against Kamil were similar, the court found it appropriate to grant him bail. The state counsel opposed the bail application, but could not dispute the fact that other co-accused persons had been granted bail in their respective appeals.
In granting bail, the High Court emphasized the importance of adhering to the principle of parity in similar cases. The court set aside the impugned order of the Special NIA Court refusing bail and directed Kamil's release on the condition of furnishing a personal bond and sureties as per the court's directions.
This decision underscores the judiciary's commitment to ensuring fairness and consistency in legal proceedings, particularly in cases involving national security. By granting bail based on the principle of parity, the High Court has reinforced the importance of equal treatment under the law for all individuals, irrespective of the charges against them.
