Delhi High Court Closes Maggi’s Trademark Infringement Suit After Utensils Manufacturer Undertakes To Stop Use Of “Maggisun”

The Delhi High Court has formally closed a trademark infringement suit filed by Nestlé in respect of its “Maggi” brand, following a settlement in which the defendant, an utensils manufacturer, agreed to desist from using the name “Maggisun” or any mark confusingly similar to “Maggi.” The case, instituted in 2018 by Societe Des Produits Nestlé S.A., identified Shankeshwar Utensils & Appliances Private Limited as the party manufacturing and distributing goods under the mark “Maggisun.” The defendant, through the settlement, acknowledged Nestlé’s ownership of the “Maggi” trademark and affirmed the validity of Nestlé’s trademark registrations.

Under the terms of the settlement, the defendant agreed that it would no longer manufacture or sell pressure cookers or any other goods under the trade mark “Maggisun,” “Maggi,” or any name that could be considered identical or deceptively similar to “Maggi.” The undertaking extended to prohibiting the defendant from advertising “Maggisun,” “Maggi,” or any analogous trademark across all media types—print, electronic, social, or e-commerce platforms. The defendant also committed to destroying all existing goods bearing “Maggisun,” “Maggi,” or any confusingly similar mark, and further agreed to cancel the trademark registration for “Maggisun.” Following this settlement, Nestlé’s legal team indicated that it would not press the remaining reliefs sought in the suit so long as the court decreed the suit in the terms of the settlement arrived at between the parties.

Justice Tejas Karia accepted the settlement and ordered that the suit be decreed accordingly, directing that a decree sheet be drawn up in conformity with the terms agreed by the parties. The court also admonished both parties to abide by the obligations set forth in the settlement. With the matter thus resolved, the suit titled Societe Des Produits Nestlé S.A. & Anr v. M/s Shree Shankeshwar Utensils & Appliances Pvt Ltd now stands disposed, having secured the withdrawal of “Maggisun” in the utensils space and the reaffirmation of Nestlé’s exclusive trademark rights over “Maggi.”
