The Delhi High Court has quashed a dowry harassment and cruelty FIR filed by a woman against her in-laws following her husband's suicide just 40 days after their marriage. Justice Neena Bansal Krishna observed that the allegations were vague and constituted an abuse of legal process, deeming it unjust to allow criminal proceedings to continue.
The petitioners, comprising the husband’s father, mother, and sister, sought quashing of the chargesheet filed under Sections 498A, 406, and 34 of the Indian Penal Code. They contended that their son had been mentally and physically harassed by his wife and her parents, which allegedly led to his suicide on April 13, 2016. They further stated that the wife left the matrimonial home shortly after the cremation and, two months later, filed a complaint alleging dowry harassment and abetment of suicide against them.
The Court noted that the marriage had lasted only 40 days and the allegations were made after the husband’s death. It emphasized that such belated and vague accusations could not sustain criminal proceedings. The bench highlighted the importance of protecting individuals from frivolous legal actions that misuse the judicial system and cause unnecessary harassment to innocent parties.
