Kerala High Court Closes Petition in Hijab Row Following Student’s Withdrawal of Admission

The Kerala High Court has closed a writ petition filed by St. Rita’s Public School challenging a directive from the Deputy Director of Education (DDE), Ernakulam, which instructed the school to permit a Muslim student to attend classes wearing a headscarf. The case was rendered moot after the student’s parents decided to withdraw her admission from St. Rita’s and enroll her in another institution, effectively resolving the dispute without the need for judicial intervention on the substantive issues raised.

St. Rita’s Public School, a Christian management institution affiliated with the Central Board of Secondary Education (CBSE), had approached the High Court after facing threats and a mob intrusion related to the refusal to allow the student to wear a hijab with the school uniform. The school contended that the state education authorities lacked jurisdiction over CBSE-affiliated schools and sought to quash the DDE’s directive. The petition also requested a declaration of the state’s lack of authority and an interim injunction restraining any coercive action against the institution.

Justice V.G. Arun, presiding over the matter, noted that the parents’ decision to withdraw the student from St. Rita’s effectively removed the immediate cause of contention. With the student now admitted to another school, the issues raised in the writ petition no longer required adjudication. During the proceedings, the State Attorney confirmed that the state had no intention of pursuing further action, further reinforcing that the matter had been effectively resolved outside the courtroom.

The High Court observed that the resolution reflected the broader principle of fraternity, a core constitutional value, emphasizing the importance of mutual respect and harmony in resolving sensitive matters involving personal freedoms and educational institutions. By closing the petition, the Court avoided unnecessary litigation while ensuring that the school and the state authorities were not placed in a position of conflict over jurisdictional issues.

This development highlights the judiciary’s preference for practical resolution of disputes, particularly where the underlying controversy has been settled through voluntary action by the parties involved. It underscores the balance the courts seek to maintain between enforcing statutory mandates and respecting individual rights, including the freedom of parents to choose an appropriate educational environment for their children. The case also demonstrates the role of the judiciary in upholding constitutional values while facilitating amicable solutions that preserve social harmony.
