Allahabad High Court Seeks Report on Allegations That Advocate Was Coerced into Withdrawing Vakalatnama

The Allahabad High Court (Lucknow Bench) has raised serious concerns after it was alleged that an advocate was threatened inside a courtroom and forced to withdraw his Vakalatnama. The Court has directed the District & Sessions Judge of Lucknow to submit a report verifying these claims. The issue came up during a hearing in a transfer application filed under civil procedure law by Devi Prasad and others, seeking to move their pending appeal from a court in Lucknow to another jurisdiction.

According to the petitioners, on August 26, 2025, when their appeal was listed before the Additional District Judge in Lucknow, their counsel—Advocate K.K. Dwivedi—was allegedly intimidated by private party counsels and compelled to revoke his Vakalatnama. The petitioners claim that the courtroom environment had become hostile, with threats made toward their lawyer. They further alleged that another advocate, accompanied by associates, physically assaulted Devi Prasad and threatened him not to pursue his legal rights.

The High Court noted that if these allegations were true, they would seriously undermine the administration of justice and tarnish the credibility of the legal system. The bench, therefore, directed Additional Chief Standing Counsel to formally communicate the court’s order to the District & Sessions Judge, demanding a detailed inquiry into the incident. The Court ordered that the District Judge ascertain what action, if any, was taken by the concerned court, and asked him to provide his findings by the next hearing date.

This judicial step reflects the High Court’s sensitivity to the integrity of legal proceedings and its willingness to intervene when there are credible allegations of intimidation or coercion inside courtrooms. The case will next be heard on November 28, 2025, when the Court expects the report from the District Judge to guide further action.
