Karnataka High Court Orders KSCA Elections to Proceed as per Existing By-Laws

The Karnataka High Court has ruled that the Karnataka State Cricket Association (KSCA) must conduct its managing committee elections in strict accordance with its existing by-laws, rejecting attempts to delay or reinterpret the polling process. The Court intervened after the Electoral Officer of the KSCA postponed the elections, originally slated for November 30, citing unresolved legal and administrative questions.

The association had filed a writ petition challenging the deferment, demanding that the polling calendar be restored under the by-laws already in place. The High Court agreed, directing the Electoral Officer to undertake the election process without allowing any new interpretations to stall the schedule. The Court made clear that the election must proceed under the framework set out in the KSCA’s by-laws, not in response to reinterpretations introduced late by any faction.

The deferment by the Election Officer had followed a letter issued on November 17, which he claimed was necessitated by an ongoing court injunction and confusion within the managing committee over eligibility rules, particularly the so-called nine-year term rule. The Electoral Officer said he had sought clarifications from the association, but found the responses inadequate.

Several factions within the KSCA have expressed divergent positions. One group, led by former India cricketer Venkatesh Prasad, voiced strong dismay at the postponement, calling it a shock and insisting that the elections were vital for reviving high-level cricket in the state. On the other hand, another faction (the Brijesh Patel group) welcomed the High Court’s cancellation of the earlier interim order and urged that the elections proceed per the original calendar, arguing there was no longer any legal obstacle to doing so.

The Court’s intervention underscores its insistence on adherence to the association’s formal governance rules, and its refusal to permit procedural ambiguity or delay in the face of internal disputes.
