The Madras High Court has issued a temporary injunction preventing the makers of the film Aaromale from using scenes and background music from the 2010 Tamil film Vinnaithaandi Varuvaayaa. The Court found that the production company behind Aaromale did not have permission from the copyright holders, who hold both the visual and musical rights for the original film.
Presiding Justice N. Senthilkumar held that the use of those copyrighted visual sequences and music amounted to a clear infringement of the rights of the original film’s producers. The Court indicated that such use could not continue without proper authorization, especially because the content was being reused for commercial benefit. The decision was rooted in the copyright protections guaranteed by law, which prevent unauthorized reproduction or adaptation of creative content.
In reaching its conclusion, the Court noted that the plaintiffs had made out a prima facie case showing that critical elements of their film—such as specific shots, camera angles, music scores, and background themes—were being replicated in Aaromale. The fact that these elements are distinctive and central to Vinnaithaandi Varuvaayaa strengthened the case for granting the injunction.
By granting this interim remedy, the High Court emphasized that respect for intellectual property law must be maintained in the film industry. Filmmakers cannot reuse or replicate visually and musically protected content simply because it holds cultural or nostalgic value. Proper licensing and permission are essential, even when creators may feel homage or homage-like inspiration.
As a result of the order, Aaromale’s producers must cease distribution or exhibition of any portion of the film containing the disputed copyrighted sequences, at least until the copyright issue is thoroughly resolved in court. The ruling underscores the judiciary’s support for strong copyright safeguards, ensuring original creators’ rights are protected even in an industry driven by creativity and inspiration.
