The Allahabad High Court strongly criticised the police authorities for blocking a woman’s mobile phone number based on what it described as a false and baseless complaint filed by her husband. The Court observed that the action was taken without conducting any proper inquiry and reflected a serious misuse of authority that interfered with the woman’s fundamental rights and personal liberty.
The matter came before the Court after the woman challenged the blocking of her mobile number. According to the case, the woman’s husband had lodged a complaint alleging that she was misusing her phone and engaging in objectionable activities. Acting on the complaint, the police initiated steps that resulted in the blocking of the woman’s mobile connection.
The petitioner argued that the allegations made by her husband were entirely false and motivated by personal disputes arising out of matrimonial discord. She contended that the police authorities acted mechanically on the complaint without verifying the claims or conducting any independent investigation. As a result, her mobile number was blocked, causing significant inconvenience and affecting her ability to communicate and carry out daily activities.
During the proceedings, the Court examined the circumstances under which the action had been taken. It found that the police had acted solely on the basis of the husband’s allegations and had not undertaken any meaningful inquiry before recommending or facilitating the blocking of the number. The Court observed that such action could not be justified merely because a complaint had been received.
The High Court noted that a mobile phone and its associated services play a crucial role in modern life and are closely connected with an individual’s ability to communicate, access services and participate in everyday social and professional activities. It observed that depriving a person of access to such communication facilities without proper legal basis can have serious consequences.
The Court expressed concern over the manner in which the authorities proceeded in the matter. It observed that public authorities are expected to act fairly, responsibly and in accordance with law. Any action affecting an individual’s rights must be preceded by proper verification and compliance with legal procedures. The Court stated that the police cannot act as a mere instrument for carrying out allegations made by one party in a personal dispute.
While considering the facts, the Court found that the complaint filed by the husband lacked substance and that there was no material to justify the drastic action taken against the woman. It observed that the authorities failed to apply their mind before proceeding and did not examine whether the allegations disclosed any legally sustainable grounds for blocking the mobile number.
The judgment highlighted that actions affecting personal liberty and communication rights cannot be taken casually or without due process. The Court emphasized that law enforcement agencies must exercise their powers carefully and ensure that any interference with individual rights is supported by valid reasons and lawful procedure.
The High Court also expressed disapproval of the tendency to misuse administrative and police machinery in matrimonial and personal disputes. It observed that authorities must remain neutral and avoid becoming tools in conflicts between private parties. The Court stressed that complaints arising out of domestic or matrimonial disagreements require careful scrutiny before any coercive action is taken.
After examining the record, the Court concluded that the blocking of the woman’s mobile number was unjustified and had been carried out without adequate inquiry. It criticised the conduct of the police authorities and underscored the need for greater accountability in the exercise of official powers. The Court’s observations reaffirmed that actions affecting individual rights must be based on law, supported by evidence and undertaken only after following proper procedure.
The judgment serves as a reminder that administrative and police powers cannot be exercised arbitrarily or on the basis of unverified allegations. It emphasizes that authorities are required to act with fairness, caution and respect for constitutional rights, particularly when their decisions have the potential to affect a person’s liberty, dignity and ability to communicate.
