The Madras High Court has refused to grant relief to an MBBS student whose tuition fee amount was frozen by the National Investigation Agency during an investigation into alleged links with a Maoist organisation. The court declined to interfere with the action taken by the NIA and dismissed the petition filed by the student seeking removal of the freeze on the fee amount.
The case concerned a medical student studying at a private medical college, whose tuition fee payment came under the scrutiny of the investigating agency. The NIA had frozen the amount after alleging that the funds used for paying the student’s medical education fees were connected with an organisation allegedly involved in Maoist activities.
The student approached the Madras High Court challenging the freezing order passed by the NIA. She sought directions from the court to release the amount, stating that the action was affecting her education and creating difficulties in obtaining necessary documents and completing academic requirements from the college.
The student argued that the tuition fee had already been paid towards her medical education and that the freezing of the amount was causing hardship. She submitted that she had no connection with any unlawful activity and that the action against the funds was affecting her academic progress.
The NIA opposed the request and informed the court that the investigation related to the source of the funds used for paying the tuition fee. The agency alleged that the amount was connected to funds provided by a Maoist organisation based in Jharkhand and that the transaction was part of the investigation into alleged financial links.
The proceedings before the Madras High Court involved examination of the legality of the NIA’s action and whether the student was entitled to relief while the investigation was ongoing. The court considered the claims made by the student as well as the position taken by the investigating agency.
The student’s petition stated that the freezing of the fee amount had affected her relationship with the medical college. She claimed that the institution was not providing certain documents because of the issue concerning the payment and that the continued freezing of the funds was creating obstacles in pursuing her medical course.
The NIA maintained that the freezing order was issued as part of its investigation and that the source of the funds required examination. The agency’s position was that the amount could not be released while the investigation into the alleged financial connection was underway.
The High Court considered the circumstances of the case and refused to set aside the NIA’s order. The court observed that the student could approach the investigating agency, provide her explanation regarding the transaction, and request the authorities to consider whether the funds could be released.
The court held that it was not appropriate to interfere with the investigative action at that stage. The petition seeking relief against the freezing of the tuition fee amount was dismissed, allowing the NIA’s action to continue.
