Allahabad High Court Questions Why Lucknow Police Were “Mute Spectators” During Alleged Lawyers’ Rampage

In a strongly worded order highlighting concerns over police accountability and the sanctity of the legal profession, the Allahabad High Court questioned why the Lucknow Police acted as “mute spectators” during an alleged incident of trespass, vandalism, and intimidation involving individuals dressed as advocates. The Court observed that if the allegations are found to be true, the matter would indicate a serious breakdown of law and order and raise troubling questions about the conduct of law enforcement authorities.

The matter came before the Lucknow Bench of the Allahabad High Court through a Public Interest Litigation filed by an advocate. According to the petition, a group of persons wearing lawyers' attire entered a property being used for cricket practice and social gatherings and allegedly engaged in acts of vandalism, abuse, and intimidation. The petitioner claimed that the individuals attempted to forcibly assert control over the premises and created an atmosphere of fear among those present.

It was alleged that staff members and labourers at the property were threatened and subjected to abusive conduct. The petition further stated that CCTV cameras were damaged, bricks were thrown, and attempts were made to interfere with the peaceful use of the premises. The most serious allegation, however, was that police personnel remained present at the location for a considerable period without taking effective action to prevent the alleged unlawful activities.

During the hearing, the Bench examined video footage placed on record by the petitioner. The Court observed that the footage prima facie depicted several individuals dressed as advocates moving freely within the property while police officials appeared to be passive observers. According to the Court's observations, the incident continued for several hours without any visible intervention by law enforcement personnel.

The High Court expressed concern over the apparent failure of the police to discharge their statutory duties. It questioned why additional police force was not deployed, why no immediate arrests were made, and why officers present at the scene did not take proactive measures to restore order. The Bench noted that the role of the police is not merely to witness incidents but to prevent the commission of offences and protect citizens from unlawful acts.

One of the most significant aspects of the proceedings was the Court's observation that certain police personnel appeared to be interacting with the alleged offenders in a cordial manner. While refraining from making any definitive findings, the Court stated that it could not rule out the possibility that local police officials may have facilitated or tolerated the alleged activities. Such observations underscore the seriousness with which the Bench viewed the matter.

The Court also took note of the fact that an FIR had already been registered in connection with the incident. According to submissions made before the Bench, several advocates were named in the complaint, and some of the individuals allegedly involved were said to have connections with members of local bar associations. The Court observed that these allegations, if established, would have serious implications for the image and credibility of the legal profession.

The High Court emphasized that advocates occupy a special position within the justice delivery system. As officers of the court, they are expected to uphold the rule of law and conduct themselves in a manner that inspires public confidence. Any involvement of advocates in acts of intimidation, coercion, or unlawful conduct not only affects individual cases but also undermines the reputation of the legal community as a whole.

The Bench further remarked that disputes cannot be resolved through displays of force or attempts at vigilantism. In a constitutional democracy governed by the rule of law, individuals are required to seek remedies through lawful and judicial mechanisms. The use of intimidation or coercive tactics is fundamentally inconsistent with the principles that underpin the administration of justice.

Recognizing the gravity of the allegations, the High Court directed the Commissioner of Police, Lucknow, to personally inquire into the incident and assist the Court during subsequent proceedings. The Commissioner was asked to provide a detailed explanation regarding the actions taken by police personnel present at the scene and to clarify why the alleged activities were not immediately curtailed.

The Court also ordered that the video footage submitted by the petitioner be preserved as part of the judicial record. Preservation of the material evidence was considered necessary to ensure that the facts could be independently verified during the course of the proceedings.

Additionally, the Bench directed that adequate security be provided to the petitioner. Given the nature of the allegations and the identities of some of the individuals reportedly involved, the Court considered it appropriate to ensure that the petitioner could pursue the matter without fear of intimidation or retaliation.

Legal observers have described the case as one that raises important questions concerning police accountability and institutional integrity. If the allegations are substantiated, the matter could reveal not only a failure on the part of law enforcement authorities but also a disturbing willingness to permit unlawful conduct within the community of legal professionals.

The proceedings also come against the backdrop of increasing judicial concern regarding allegations involving criminal activities by members of the Bar. Courts across the country have repeatedly emphasized that the legal profession must maintain the highest standards of ethics, discipline, and respect for the law. The present case has therefore acquired significance beyond the immediate facts of the dispute.

Importantly, the High Court has not arrived at any final conclusions regarding the culpability of the individuals named in the proceedings. The observations made thus far are preliminary and intended to facilitate a comprehensive inquiry into the incident. The matter remains pending, and the findings of the police investigation, coupled with the evidence placed on record, will determine the future course of the proceedings.
