In a significant order concerning the administration of cricket in the State, the Rajasthan High Court suspended the functioning of the Ad Hoc Committee of the Rajasthan Cricket Association (RCA) and appointed senior IAS officer Bhaskar A. Sawant as the interim administrator to manage its affairs. The Court observed that the committee had failed to achieve the principal objective for which it had been constituted, namely conducting elections within the stipulated period. Holding that a temporary administrative arrangement cannot continue indefinitely, the Court directed that the Association be placed under the supervision of an independent administrator until further orders.
The matter came before the High Court through a Public Interest Litigation (PIL) challenging the continued functioning of the Ad Hoc Committee. The petitioner contended that the committee had originally been constituted only as a temporary arrangement to administer the affairs of the Association and conduct fresh elections within a specified timeframe. However, despite the passage of considerable time, elections had not been held, and the committee continued to function through repeated extensions of its tenure.
It was argued that the prolonged continuation of the Ad Hoc Committee defeated the very purpose of its appointment. According to the petitioner, the committee had been entrusted with ensuring a smooth transition to a democratically elected governing body, but instead it continued to exercise administrative control without completing the electoral process. Such an arrangement, it was submitted, undermined the principles of democratic governance and accountability that are fundamental to the functioning of sports associations.
After considering the submissions, the Rajasthan High Court expressed concern over the prolonged delay in conducting elections. The Court observed that an ad hoc committee is, by its very nature, intended to function only as a temporary mechanism until a regularly elected body assumes office. If such committees are permitted to continue indefinitely, they cease to remain temporary and undermine the democratic structure contemplated under the governing framework of the Association.
The Court noted that despite having sufficient time to complete the election process, the Ad Hoc Committee had failed to discharge its primary responsibility. The repeated extensions granted to the committee had not resulted in the conduct of elections, leaving the Association without a democratically elected governing body for an extended period. The Court held that such a situation could not be permitted to continue indefinitely.
In view of these circumstances, the High Court suspended the functioning of the Ad Hoc Committee with immediate effect. To ensure that the administration of the Rajasthan Cricket Association continued without disruption, the Court appointed senior IAS officer Bhaskar A. Sawant as the interim administrator. He was entrusted with the responsibility of managing the day-to-day affairs of the Association until further directions are issued by the Court.
The Court also examined the role of the Registrar of Cooperative Societies in relation to the delayed election process. It sought an explanation regarding the failure to ensure compliance with earlier directions concerning the conduct of elections and indicated that authorities entrusted with implementing judicial orders are expected to act diligently and within a reasonable timeframe. The Court observed that administrative authorities cannot permit temporary arrangements to continue endlessly without adequate justification.
Emphasizing the importance of democratic governance in sports administration, the High Court observed that elected office-bearers derive their legitimacy from the electoral process and remain accountable to the members of the Association. Temporary administrative bodies, on the other hand, are created only to address exceptional situations and are not intended to replace elected governing bodies for prolonged periods. The Court stressed that transparency, accountability, and regular elections are essential for maintaining confidence in the administration of sporting institutions.
The appointment of an independent administrator is intended to facilitate the smooth functioning of the Association while ensuring that the long-pending electoral process is completed expeditiously. The administrator is expected to oversee the affairs of the Association impartially and take necessary steps for conducting elections in accordance with the applicable legal framework, thereby enabling the formation of a duly elected executive body.
The order represents an important reaffirmation of the principle that democratic governance cannot be indefinitely replaced by temporary administrative arrangements. By suspending the Ad Hoc Committee and appointing an independent administrator, the Rajasthan High Court has sought to restore transparency, accountability, and institutional stability within the Rajasthan Cricket Association while paving the way for the early constitution of a democratically elected governing body.
