The Delhi High Court sharply censured a man for filing a writ petition in the name of a non-governmental organization (NGO) without authorization, describing the act as deceitful and an abuse of the court process. The petition related to alleged illegal construction in the Jamia Nagar area of Delhi. The court noted that the man had apparently misused the letterhead of the NGO to file the plea. Subsequently, the head of the NGO appeared in court and clarified that the individual was unconnected with the organization and asked that the petition be withdrawn. The Municipal Corporation of Delhi (MCD), through its counsel, informed the court that action against the property had already begun and that demolition had partially taken place, as evidenced in photographs filed before the court.
Justice Mini Pushkarna expressed consternation at the misuse of the NGO’s name by someone who had no legitimate connection to it. She observed that when an unauthorized person files a petition seeking action against an alleged unauthorized construction using an NGO’s identity, it not only amounts to deceit but represents a misuse of the legal process. The court remarked on the seriousness of such acts given the solemn duty of courts to dispense justice, stressing that when a litigant seeks to exploit court processes for personal or covert motives, judicial censure becomes imperative. The court held that the filing of a petition under an NGO’s name, without any authorization or concern of the deponent with that NGO, amounts to a gross malpractice that cannot be condoned lightly.
In view of these findings, the court imposed a cost of ₹50,000 on the petitioner, identified as Farid Ali. Further, it directed the Deputy Commissioner of Police to investigate the matter and take appropriate action against him. The court’s order underscores its intolerance for misrepresentation in litigation and its resolve to ensure that legal processes are not subverted by individuals acting in disguise or under false pretences.
