Andhra Pradesh High Court Grants Partial Relief In Case Over Allegedly Fake Social Media Post

The Andhra Pradesh High Court granted partial relief in a case involving allegations relating to a fake social media post, while allowing the investigation to continue in accordance with law. The Court examined the allegations made against the petitioner and assessed whether the material on record justified the continuation of all charges that had been invoked by the investigating authorities.

The case arose from a complaint alleging that a false or fabricated post had been circulated through social media platforms. Based on the complaint, criminal proceedings were initiated and various offences were invoked against the accused. The petitioner approached the High Court seeking relief from the criminal proceedings, contending that the allegations and the material collected during the investigation did not justify the application of all the offences that had been registered.

During the proceedings, the Court examined the contents of the complaint, the nature of the social media post in question and the provisions of law that had been invoked. It considered whether the allegations, even if accepted at face value, were sufficient to attract the ingredients of the offences alleged by the prosecution.

The High Court observed that criminal law cannot be invoked mechanically and that every offence requires the existence of specific legal ingredients. The Court noted that the allegations must disclose a prima facie case before a person can be subjected to prosecution for a particular offence.

After analysing the record, the Court found that certain allegations did not satisfy the requirements necessary for some of the offences that had been invoked. Consequently, it granted partial relief by setting aside the proceedings to the extent they related to those offences. However, the Court was not persuaded to terminate the entire criminal case.

The Court observed that some aspects of the matter required further investigation and factual examination. It held that disputed questions concerning the creation, circulation and impact of the alleged fake post could not be conclusively determined in proceedings seeking quashing of criminal charges.

While granting limited relief, the High Court emphasized that courts exercising jurisdiction to quash criminal proceedings must be cautious and should not conduct a detailed appreciation of evidence at a preliminary stage. The Court observed that where allegations disclose a prima facie case and require factual investigation, the investigating agency should ordinarily be permitted to proceed.

The judgment reiterated that freedom of expression and use of social media platforms do not provide protection against accountability where false or misleading content gives rise to legally cognisable offences. At the same time, the Court stressed that criminal liability can arise only when the statutory ingredients of the alleged offences are clearly made out.

Accordingly, the High Court partly allowed the petition by granting relief with respect to certain charges while permitting the investigation and remaining proceedings to continue in accordance with law. The decision balanced the need to prevent unwarranted prosecution with the requirement that allegations warranting investigation should be examined through the legal process.
